My heart goes out to this injured victim and his or her family. I hope the bicyclist in this case did not suffer catastrophic injuries. I wish the victim the very best for a quick and full recovery.

Bicycle Accident Statistics

According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were three fatalities and 355 injuries as a result of bicycle accidents in San Diego. Countywide, seven people died and 959 were injured as a result of bicycle accidents during the same year.

What Caused this Accident?

Based on this news report, it is not quite clear how or why this bicycle versus car accident occurred. There are still several unanswered questions here. Where was the bicyclist riding at the time of the collision? Was he or she crossing the street or riding along the side of the roadway? Was the motorist impaired, distracted speeding or otherwise negligent at the time? Was there a dangerous condition on the roadway, which may have caused or contributed to the incident? I trust officials are looking at these and other issues in order to determine what occurred and why.

Fault and Liability

If the motorist is determined to have been at fault, then he or she could be held financially responsible for the injuries caused. Injured victims in such cases can seek compensation to cover medical expenses, loss of wages, cost of compensation, rehabilitation, physical therapy and other related damages.

Victims or their families would be well-advised to consult with an experienced San Diego personal injury lawyer, who will stay abreast of the official investigation and make sure that their legal rights and best interests are protected. A skilled car accident lawyer will also be able to determine whether a dangerous roadway condition caused or contributed to the accident. If that was the case, the city or governmental agency responsible for maintaining that roadway could also be held liable. Under California Government Code section 911.2, any claim against a governmental entity must be filed within 180 days of the accident or injury.

The San Diego Union-Tribune reports that the deadly crash occurred at the intersection of Vandegrift Boulevard and Parker Street in Oceanside. Leon was taken to a local medical center where she was pronounced dead. The driver of the vehicle that hit Leon told officials that she had the green light at the intersection at the time of the collision. Officials are still investigating the incident.

My heart goes out to the family and friends of Martha Leon for their irreparable loss. I offer my deepest condolences to them.

Pedestrian Accidents

Countywide in San Diego, 63 people died and 998 were injured due to pedestrian accidents, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). In the city of Oceanside, two deaths and 59 injuries were reported as a result of pedestrian accidents in 2008.

Crosswalk Laws

California Vehicle Code section 21950 states: "The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection." The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk "shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian."

Leon, according to this report, was crossing at a street intersection. I trust officials are verifying the driver's account and examining the evidence and witness statements in order to determine exactly what occurred here. It is also important to look into whether the driver was impaired, distracted, speeding or otherwise negligent.

Claim for Compensation

An experienced San Diego personal injury lawyer will be able to advise victims about their legal rights and options. The best personal injury law firms will always offer a free and comprehensive consultation to injured victims and their families.

As a pedestrian, what precautions do you take, especially at crosswalks and intersections to prevent a collision?

Officials say Swanson struck a pedestrian in a Huntington Beach crosswalk at the corner of Magnolia Avenue and PCH the afternoon of June 6, 2010 and then fled the scene. The pedestrian, a 21-year-old man, was taken to a local hospital and is expected to survive. Police caught up with Swanson as he was driving to his Newport Beach home and arrested him.

I'm relieved to hear that the pedestrian has not sustained any life-threatening injuries. I hope he recovers quickly and completely.

Pedestrian Accidents

There were five fatalities and 59 injuries involving pedestrian accidents in Huntington Beach, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). In Orange County as a whole, 31 people were killed and 122 were injured as a result of pedestrian accidents during the same year.

Crosswalk Laws

California law requires motorists to yield right-of-way to pedestrians in crosswalks and at intersections.

In this case police say the motorist, Swanson, was also under the influence and left the scene of the accident. DUI is illegal under California Vehicle Code Section 23152 (a) and leaving the scene of an accident or hit-and-run is a serious crime under California Vehicle Code 20001 (a).

Claim for Compensation

In such cases where negligence and/or wrongdoing is suspected, injured victims would be well-advised to contact a reputed Orange County personal injury lawyer who has a successful track record of holding drunk drivers accountable.

What precautions or proactive steps can pedestrians in crosswalks take to avoid such collisions?

The fatal collision occurred the morning of April 25, 2010 when the driver of a Dodge Ram going west on First Street, ran a red light and struck Rivera-Garcia. The critically injured pedestrian was taken to an area hospital, but succumbed to her injuries. An investigation is ongoing.

My heart goes out to everyone who knew and loved Maria Rivera-Garcia for their devastating loss. They will be in my prayers.

Violation of Traffic Laws

If the details of this news report are accurate, it appears that the driver in this case failed to yield right-of-way to the pedestrian and ran a red light. Motorists are required to yield right-of-way to pedestrians in marked or unmarked crosswalks or at intersections under California Vehicle Code Section 21950. Running a red light is also a serious violation. California Vehicle Code Section 21453 (a) states: "A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown."

Liability Issues

It is not clear how or why the driver of the Dodge Ram ran the red light. Was he intoxicated? Was he distracted or inattentive? Was he speeding and/or driving recklessly? I trust officials are looking into these and other issues in order to determine what occurred here. It would be in the best interests of Rivera-Garcia's family to consult with an experienced Orange County personal injury lawyer, who will analyze all aspects of this accident and make sure that the negligent parties are held liable. The North County Times reports that the injury collision occurred near the intersection of Cole Grade and Horse Creek roads on April 10, 2010. The victim was taken to an area medical center for treatment. California Highway Patrol officials believe that the young man may have suffered a broken leg.

It appears that the boy thankfully, did not suffer any catastrophic injuries although they were serious injuries. I wish this victim well and hope he recovers quickly from his injuries.

San Diego Pedestrian Accident Statistics

In San Diego County as a whole, in 2008, 63 people died and 993 were injured in pedestrian accidents. Also, car accidents in San Diego claimed 246 lives and caused 13,527 injuries during the same year.

California Pedestrian Law

Under California Vehicle Code section 21950, the driver of a vehicle is required to yield right-of-way to a pedestrian crossing the street within any marked or unmarked crosswalk or at an intersection. Driver are required by law to slow down as they approach crosswalks and/or intersections and exercise due care to ensure the safety of pedestrians crossing the street. Pedestrians also have a responsibility under the law to yield right-of-way to oncoming vehicles. Violations such as jaywalking are also punishable under California law.

In this particular case, we don't know exactly what caused this serious injury accident. If this accident was the driver's fault, then he or she could be held liable for the accident and resulting injuries. If a dangerous condition at the intersection caused or contributed to this accident, the governmental entity responsible for maintaining the roadway could be held liable as well. Under California Government Code Section 911.2, any claim against a governmental agency must be filed within six months of an accident or injury. A reputed personal injury lawyer in San Diego will be able to advise victims and their families about their legal rights and options.

The injury accident happened the morning of March 9, 2010 when the woman was walking in a marked crosswalk on Presidio Avenue at Pine Street. The city garbage truck was turning on to Presidio Avenue from Pine Street when it struck the woman. The injured pedestrian was taken to an area hospital for treatment of her injuries. However, officials say the victim's injuries were not life-threatening. An investigation into the incident is ongoing.

My heart goes out to this injured victim. I wish her the very best for a quick and complete recovery. Please keep her in your prayers.

Accident Statistics

According to California Highway Patrol's Statewide Integrated Traffic Records System (SWITRS), there were 16 fatalities and 790 injuries involving pedestrian accidents in San Francisco in 2008. Also, 35 deaths and 3,577 injuries were reported as a result of all car accidents in the city of San Francisco during the same year.

How Did this Accident Occur?

If the details of this news report are accurate, the woman was in a marked crosswalk and the driver of the garbage truck should have yielded right-of-way to the pedestrian in the crosswalk.

If I were the victim or a member of her family, I would also question why the garbage truck driver did not see the pedestrian. Was he impaired, distracted, speeding or otherwise negligent at the time? I trust authorities are looking into these and other issues in order to determine exactly what happened here.

Claim for Compensation

If the garbage truck driver is determined to have been at fault for this accident, he and his employer, the city of San Francisco, could be held liable for the injuries caused to this woman. In California, any personal injury or wrongful death claim against a governmental agency must be filed within 180 days of the accident or injury. An experienced San Francisco personal injury lawyer will stay on top of the investigation and help victims protect their rights during what can be a complex legal process.

The San Francisco Examiner reports that the woman was walking across the street at Ocean and Miramar avenues the afternoon of February 9, 2010 when a city Public Utilities Commission truck hit her. The fatal pedestrian accident occurred as the truck was trying to make a left turn on Ocean. Huang was pronounced dead at the scene. Separate investigations are being conducted into this incident by both the police and the commission.

I offer my deepest sympathies to everyone who knew and loved this woman. My heart goes out to her family and friends for their tragic loss. They will be in my prayers.

San Francisco Pedestrian Accident Statistics

Two months ago, a group called Transportation for America released a study, which showed that 27 percent of all traffic accident fatalities in the San Francisco region (including Oakland and Fremont), involved pedestrian accidents. In 2008, pedestrian accidents claimed 72 lives in San Francisco. That number was up from 64 in 2007.

What Caused this Accident?

If the details in this news report are accurate, it seems that Huang was crossing the street at the intersection. However, we do not know who had the right-of-way in this case. Police have received different accounts from eyewitnesses, which makes the investigation all the more challenging.

An Experienced Injury Lawyer Can Help

Huang's family would be well-advised to contact a reputed San Francisco personal injury lawyer, who will analyze all facets of this incident and make sure that the negligent parties are held liable. If there was negligence on the part of the truck driver, Huang's family will be able to file a wrongful death lawsuit against the city. California law requires that any claim against a governmental agency be filed within six months of the accident or injury.

The fatal pedestrian accident occurred when the man, who has not yet been identified, was walking across Wardlow Road at Santa Fe Avenue, in a crosswalk. A large truck, which was attempting to make a turn, hit him. The man died of injuries sustained in this accident.

My heart goes out to the family and friends of the fatally injured man. I offer my deepest sympathies to them for their tragic and heartbreaking loss. This grieving family will be in my prayers.

Pedestrian Accidents

There were 15 fatalities and 274 injuries involving pedestrian accidents in Long Beach in 2007, according to California Highway Patrol's Statewide Integrated Traffic Records System (SWITRS). Countywide, 210 people died and 5,095 were injured as a result of pedestrian accidents during the same year. Also, in Los Angeles County, 712 fatalities and 56,475 injuries were reported due to car accidents in 2007.

Pedestrian Laws

If the details of this news report are accurate, it seems to me that the driver of the big rig simply did not see the pedestrian in the marked crosswalk. The question is why did the driver not see the pedestrian. Motorists are required under California law to yield right-of-way to pedestrians in crosswalks. California Vehicle Code Section 21950 states: "The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection."

Liability Issues

In this case, it is important to determine whether the truck driver failed to yield right-of-way to the pedestrian in the crosswalk. If that was the case, the big rig driver could be cited for breaking the law and he and his employer could be held financially responsible for the accident and injuries caused. An experienced Long Beach personal injury attorney, will help the victim's family file a claim against the negligent parties involved. A knowledgeable car accident lawyer will also be able to determine whether a dangerous condition on the roadway caused or contributed to this fatal accident. If that was the case, the city could also be held liable. Any claim against a governmental agency must be filed within 180 days of the accident or injury, under California Governmental Code section 911.2.

The fatal pedestrian accident occurred the evening of January 21, 2010 in the Kearny Mesa area. The woman was walking across Clairemont Mesa Boulevard at Shawline Street when the television news vehicle -- an SUV -- struck her. The driver of the vehicle told authorities that he did not see the woman walking at the intersection and that she was not in a crosswalk. The woman was transported to a local hospital where she died of head injuries. The driver is not expected to be cited or arrested.

My heart goes out to everyone who knew and loved this woman. I offer my deepest sympathies to her family members for their tragic loss. They will be in my thoughts and prayers.

Pedestrian Accident Statistics

There were 25 fatalities and 575 injuries involving pedestrian accidents in San Diego, according to CHP's 2007 traffic accident statistics. In San Diego County as a whole, 51 deaths and 1,068 injuries were reported as a result of pedestrian accidents in 2007.

California Laws Involving Pedestrians

It's not entirely clear, based on this news report, whether the woman was crossing at an intersection or not. We also do not know if the driver had a green light and whether the eyewitness reports specifically stated that the woman was not in a marked/unmarked crosswalk.

In such cases it would be in the best interests of victims and their families to seek the counsel of a reputed San Diego personal injury lawyer, who will ensure that their legal rights are protected. The San Diego Union-Tribune reports the injury collision happened near the intersection of Greenfield Drive and Peerless Drive in El Cajon. El Cajon police officials said the pedestrian, who has not yet been identified, was taken to a local hospital with major injuries.

I sympathize with this victim who has obviously been seriously hurt in this car crash. I hope and pray that this injured victim makes a quick and complete recovery. This individual will certainly be in my prayers.

Pedestrian Accident Statistics

There were 45 injuries involving pedestrian accidents in El Cajon, according to California Highway Patrol's 2007 Statewide Integrated Traffic Records System (SWITRS). In San Diego County, pedestrian accidents claimed 51 lives and caused 1,068 injuries in 2007.

What Caused this Accident?

There is not much information here about how or why this serious injury pedestrian accident occurred. We don't know whether the pedestrian was crossing the street or walking legally on the roadway or whether the driver was at fault. Did the driver or the pedestrian fail to yield right-of-way?

If the driver is determined to have caused the accident, he or she could be held liable. If a dangerous condition on the roadway caused or contributed to this accident, then the city or governmental agency responsible for maintaining that roadway can be held liable as well. Any claim against a governmental agency in California must be filed within six months of the accident or injury. An experienced San Diego personal injury lawyer will be able to better explain to victims and their families about their legal rights and options, in such cases.
