Authorities have identified two persons who were seriously injured in a motorcycle accident the afternoon of June 30, 2010 as Bryan Mucke, 56, and Deborah Mucke, 52. The Patterson Irrigator reports that the couple was heading on the 5 Freeway southbound when they hit tire debris that had been dropped, possibly, by a tractor-trailer. Both suffered major, but non-life-threatening injuries, and were taken to an area hospital.

I sympathize with this couple for what they are going through at this time. I wish them the very best for a quick and full recovery. Please keep them in your thoughts and prayers.

Motorcycle Accident Statistics

In Stanislaus County, there were 45 deaths and 2,583 personal injuries involving traffic accidents in 2008, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). Also, countywide, 10 people died and 137 were injured as a result of motorcycle accidents.

Law and Liability Issues

California Vehicle Code section 23112 (a) states: "No person shall throw or deposit, nor shall the registered owner or the driver, if such owner is not then present in the vehicle, aid or abet in the throwing or depositing upon any highway any bottle, can, garbage, glass, nail, offal, paper, wire, any substance likely to injure or damage traffic using the highway, or any noisome, nauseous, or offensive matter of any kind."

However, hundreds of people lose their lives each year and thousands are injured as a result of roadway debris. Motorcyclists are particularly vulnerable when it comes to debris on the roadway. If it is determined that the tractor-trailer's driver caused this accident, then the driver and the trucking company can be held financially responsible for the victims' serious injuries.

In such cases, injured victims would be well-advised to seek the counsel of a reputed California personal injury lawyer who will stay abreast of the investigation and make sure that their legal rights and best interests are protected. A knowledgeable car accident lawyer will also advise victims about how their own car insurance policy applies to a roadway debris accident where the at-fault driver has not been located or identified.
