A pedestrian accident in Santa Ana proved fatal for 43-year-old Maria Rivera-Garcia who was walking in a marked crosswalk at the intersection of First and Center streets, The Orange County Register reports. The fatal collision occurred the morning of April 25, 2010 when the driver of a Dodge Ram going west on First Street, ran a red light and struck Rivera-Garcia. The critically injured pedestrian was taken to an area hospital, but succumbed to her injuries. An investigation is ongoing.

My heart goes out to everyone who knew and loved Maria Rivera-Garcia for their devastating loss. They will be in my prayers.

Violation of Traffic Laws

If the details of this news report are accurate, it appears that the driver in this case failed to yield right-of-way to the pedestrian and ran a red light. Motorists are required to yield right-of-way to pedestrians in marked or unmarked crosswalks or at intersections under California Vehicle Code Section 21950. Running a red light is also a serious violation. California Vehicle Code Section 21453 (a) states: "A driver facing a circular red signal shall stop at the limit line before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown."

Liability Issues

It is not clear how or why the driver of the Dodge Ram ran the red light. Was he intoxicated? Was he distracted or inattentive? Was he speeding and/or driving recklessly? I trust officials are looking into these and other issues in order to determine what occurred here. It would be in the best interests of Rivera-Garcia's family to consult with an experienced Orange County personal injury lawyer, who will analyze all aspects of this accident and make sure that the negligent parties are held liable. The best personal injury law firms will always offer a free and comprehensive consultation to injured victims and their families.
