A man who was killed in a motorcycle accident in Ontario the morning of June 13, 2010, has been identified by authorities as 45-year-old Enrique Jose Salas. The San Bernardino Sun reports that the deadly collision occurred at the intersection of Turner Avenue and Silver Saddle Street. A Ford Ranger pickup truck that was turning left at the intersection struck Salas who was going south on Turner. Authorities are investigating this incident.
My deepest sympathies and prayers go out to the grieving family of Enrique Jose Salas. It must be a devastating loss for everyone who knew and loved this man.
Car Accident Statistics
There were 17 deaths and 1,012 injuries involving car accidents in Ontario, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). In San Bernardino County, 263 people died and 8,504 were injured as a result of car accidents during the same year.
Left Turn Law
According to California Vehicle Code Section 21801 (a): "The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety."
Claim for Compensation
There are many questions that have not been answered in this case. Who had the right-of-way at the intersection? How fast were both vehicles traveling? Who had the light? Was the driver of the other vehicle intoxicated? Was he or she distracted, speeding or otherwise negligent at the time?
If the other driver is determined to have been at fault, he or she could be held liable for Salas' wrongful death. An experienced San Bernardino personal injury lawyer will be able to advise victims' families about their legal rights and options in such cases.
