I sympathize with the injured victim. I hope and pray this person did not sustain major injuries and that he or she makes a quick and complete recovery. Please keep this injured victim in your prayers.

San Diego Pedestrian Accident Statistics

There were 23 fatalities and 533 injuries involving pedestrian accidents in San Diego, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). In San Diego County as a whole, pedestrian accidents claimed 63 lives and injured 998 people in 2008.

Leaving the Scene of an Accident

Based on this news report, it appears the pickup truck hit the victim and left the scene of the accident, which is a serious crime under California law. According to California Vehicle Code section 20001: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident." If you are a motorist who has been involved in a car accident, it is imperative that you remain at the scene until authorities arrive – whether or not the accident was your fault. Motorists are also required to assist injured victims, if it is possible for them to do so safely.

Liability Issues

Victims and their families in such cases would be well-advised to contact a reputed San Diego personal injury attorney, who will stay abreast of the official investigation and protect their rights. A knowledgeable car accident lawyer will also be able to determine if there was a dangerous condition on the roadway, which caused or contributed to this accident. If that was the case, the city or governmental agency responsible for maintaining the roadway could be held liable as well. Any such claim against a California governmental entity must be filed within 180 days of the accident or injury.
