Authorities have identified an 80-year-old woman killed in an Orange County car accident as Edelgard Owens. The Orange County Register reports that Owens was riding her bicycle across the street in a crosswalk the evening of October 21, 2009 when she was hit by a pickup truck. She was transported to an area hospital where she died.
I deeply sympathize with Owens' family and friends. This must be a terribly heartbreaking loss for everyone who knew and loved this woman, whom many describe as someone with a zest for life. This grieving family will be in my prayers.
Car Accident Investigations Can Be Complex
If the news report is accurate, there are many questions as far as this bicycle accident is concerned. First, police held 46-year-old Linda Denise Christie, the driver of the pickup, on suspicion of driving under the influence. Officers administered field sobriety tests based on which they arrested her. But they later released Christie after she passed some other mobility tests in the police station. Police officials also say Owens was crossing against a red light and that Christie had the green arrow to turn left. Further, they have ruled out any charges and are investigating the case further.
This case is a great example of how car accident investigations can be very complex. In some cases, police may get conflicting reports. In other cases, they might make an erroneous determination in the beginning and later correct it. As the case unfolds, more details surface and the facts become that much clearer.
Contacting an Experienced Bicycle Accident Attorney
In car accidents involving serious injuries, it would be in the victim's or their family's best interest to retain the services of a reputed Orange County personal injury attorney who will stay on top of the investigation and make sure their legal rights are protected. Skilled car accident lawyers should also look into whether there was a dangerous condition on the roadway, which caused or contributed to the accident. If that was the case, the city or governmental agency responsible for maintaining the roadway could be held liable. Any such claim against a governmental entity must be filed within six months of an accident or injury
