Orange County Car Accident Proves Fatal for Woman

A woman who sustained fatal injuries in a Huntington Beach car accident the night of January 28, 2010, was identified by the Orange County Coroner as 70-year-old Olga Reveles. The Orange County Register reports that the fatal pedestrian accident occurred when Reveles was hit walking across Pacific Coast Highway at 9th Street, by a 2003 Chevy pickup truck. Investigators are still looking into whether Reveles was inside a marked crosswalk at the time of the crash. Authorities also mentioned that the 48-year-old driver of the Chevy was not impaired at the time of the collision.

Crosswalk Laws and Liability Issues

California law requires motorists to yield right-of-way to pedestrians walking in marked or unmarked crosswalks at intersections. California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

In this particular case, based on details provided in the news report, it is not clear whether Reveles was walking in a crosswalk.
