Distracted Driver Causes Fatal Car Accident

A 23-year-old driver who was killed in a car accident caused by a distracted driver on February 4, 2010 was identified as Luis Sarabia Trujillo. The crash also killed one of his passengers, 20-year-old Omar Gaytan. The Daily Democrat reports that the accident occurred when 53-year-old David Pearl, who was driving his 2002 Ford Ranger pickup north on County Road 89 near CR-26, became distracted while using the CD player in his truck.

Pearl lost control of his pickup truck when it went off the roadway and he overcorrected. The truck then veered into opposing lanes of traffic. California Highway Patrol officials said Pearl's truck crashed head-on into Trujillo’s 1997 Grand Am traveling in the southbound lane. He sustained major head injuries and was pronounced dead at the scene. Pearl was not seriously injured. Edward Blanco, 30, and Francisco Gonzalez, 24, two other passengers in Trujillo's car, sustained injuries and were transported to a local hospital.

My heart goes out to the family and friends of Luis Trujillo and Omar Gaytan for their devastating loss. I also hope Blanco and Gonzalez did not sustain catastrophic injuries and pray for their speedy and complete recovery.

Driver Distractions Can Be Devastating

If the details in this news report are accurate, it appears that David Pearl, the driver of the pickup truck, was at fault here because he took his eyes off the road while operating his CD player. Although officials have ruled this crash an accident and forwarded the case to the district attorney, such cases rarely get prosecuted.

Can a Distracted Driver be Held Liable?

Pearl may not be held criminally responsible in this case. However, he could still be held liable for Trujillo's and Gaytan’s deaths and the injuries caused to Blanco and Gonzalez. The injured victims could seek compensation to cover medical expenses, lost earnings, cost of hospitalization, physical therapy and other related damages. Families of the deceased victims can also file wrongful death claims seeking damages. These injured victims and the families of the deceased victims would be well-advised to contact a skilled California personal injury lawyer who will advise them about their legal rights and options.
